Resolution on Poland – Malaga, 08.06.2024

During the FBE General Congress in November 2022 the General Assembly expressed their concern about the decline of rule of law in Poland since 2015.

We note that following the general election in October 2023, a process to restore the democratic standards has been set in motion. It includes inter alia preparation of bills concerning the judicial system, the constitutional court and the prosecution services.

The essential purpose is to secure to the citizens  the right to an independent and impartial court established by law, guaranteed by the European Convention for the Protection of Human Rights.

We are satisfied that the process is heading in the right direction.  It has been acknowledged by the EU by closing the Article 7 (1) TEU procedure against Poland as there is  no longer a clear risk of a serious breach of the rule of law.  

Given the gravity of the damage  inflicted by the previous ruling coalition since 2015 on the proper functioning of the legal system,  we enjoin all responsible actors in Poland to expedite their efforts.
